This Privacy Policy describes how Chearbear ("we", "us", or "our", Buenos Aires, Argentina, collects, uses, stores, and protects the personal data and content you provide when using our social media content publishing platform. We are committed to complying with Argentina's Personal Data Protection Law No. 25.326 (Ley de Protección de Datos Personales) and applicable international standards.

1. Who We Are

Chearbear is a social media content management and scheduling service that allows clients to publish content on TikTok and other platforms on their behalf. The service is operated by an independent entrepreneur based in Buenos Aires, Argentina, reachable at [email protected].

2. Data We Collect

We collect and process the following categories of data:

• TikTok account credentials (OAuth tokens): When you connect your TikTok account, we receive and store an access token and a refresh token issued by TikTok via OAuth 2.0. These tokens allow us to publish content on your behalf without storing your TikTok password.
• TikTok profile information: Display name, profile picture URL, and TikTok account ID, retrieved at the time of authorization.
• Video and media content: Video files and associated metadata (captions, hashtags, scheduling details) that you or your representative deliver to us for publication.
• Publication metadata: Records of scheduled and published posts, including timestamps, status, and TikTok post identifiers.
• Contact information: Name and email address used for client communication.

3. How We Collect Data

• OAuth authorization: Through TikTok's official OAuth 2.0 flow, which you initiate by clicking "Connect TikTok" in our platform. You authorize the connection directly on TikTok's interface — we never see your TikTok password.
• Direct delivery: Video files and content briefs are delivered by you or your representative via agreed digital channels (email, cloud storage links, messaging platforms), and subsequently uploaded to our secure Dropbox storage for processing and scheduling.

4. How We Use Your Data

• To publish scheduled content to your TikTok account on your behalf.
• To manage token refresh cycles required by TikTok's API (every 24 hours).
• To track publication history and status for your records.
• To communicate with you about the status of your content and account.
• We do not use your data for advertising, profiling, or any purpose beyond the service rendered.

5. Video Content Storage and Retention

Video files delivered to us are stored in our Dropbox account solely for the purpose of processing and publishing. Our system applies the following automated retention policy:

• Successful publication: Upon confirming that a post has been successfully published to TikTok, the system automatically flags the associated video file for deletion. The file is permanently removed from our Dropbox storage within 30 days of the publication date.
• Failed publication: If a scheduled post fails and cannot be republished, the system flags the file for deletion and it is permanently removed within 7 days of the failure.
• Client-requested removal: You may request immediate deletion of any of your video files at any time by contacting us at [email protected].

We do not retain video content beyond the periods described above. We do not share, sell, license, or otherwise distribute your media files to any third party other than TikTok as required to fulfill the publishing service.

6. OAuth Token Retention

TikTok access tokens and refresh tokens are stored securely and are used exclusively to operate the publishing service. Tokens are immediately revoked and deleted from our systems when you disconnect your TikTok account or terminate the service agreement. We do not retain tokens after account disconnection.

7. Third-Party Services

We rely on the following third-party services to operate:

• TikTok (ByteDance): Content is published via TikTok's Content Posting API. TikTok's own Privacy Policy governs how TikTok handles data on their platform.
• Dropbox: Used as temporary secure storage for video files pending publication. Dropbox's Privacy Policy applies to data stored on their infrastructure.

We do not sell, rent, or share your personal data with any other third parties.

8. Data Security

We apply reasonable technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction. OAuth tokens are stored using encryption. Video files in Dropbox are accessible only to authorized personnel of Chearbear.

Access to the Chearbear platform is protected by two-factor authentication (2FA) via Google Authenticator, requiring both a password and a time-based one-time code for every login. This ensures that your connected TikTok credentials and scheduled content are accessible only to explicitly authorized operators, even in the event of a compromised password.

Despite these measures, no system can guarantee absolute security, and we encourage you to contact us immediately if you suspect any unauthorized use of your account.

9. Your Rights Under Argentine Law (Ley 25.326)

As a data subject under Argentine Personal Data Protection Law No. 25.326, you have the following rights:

• Right of access: Request a copy of all personal data we hold about you.
• Right of rectification: Request correction of inaccurate or incomplete data.
• Right of deletion: Request the deletion of your personal data, subject to legal or operational requirements.
• Right of opposition: Object to the processing of your data in certain circumstances.

Chearbear is a social media content management and scheduling platform that allows clients to publish video and other media content to TikTok and other social media platforms on their behalf. The service includes content scheduling, OAuth-based account connection, and publication management via authorized third-party APIs.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our service. By using Chearbear, you represent and warrant that you meet these requirements. The service is intended for professional and business use only.

3. Client Responsibilities

As a client of Chearbear, you agree to:

• Provide only content that you own or have the legal right to publish, including all necessary licenses, rights, and permissions for music, images, footage, and any third-party material included in your videos.
• Authorize Chearbear to access your TikTok account via OAuth for the sole purpose of publishing content on your behalf.
• Ensure that all content provided to Chearbear complies with TikTok's Community Guidelines, Terms of Service, and all applicable laws and regulations.
• Not provide content that is defamatory, fraudulent, obscene, discriminatory, or that infringes on the intellectual property or privacy rights of any third party.
• Maintain the confidentiality of any credentials or access links shared with you as part of the service.

4. Chearbear's Responsibilities

We commit to:

• Publishing your content to TikTok in accordance with the schedule agreed upon.
• Handling your data and media files in compliance with our Privacy Policy.
• Notifying you promptly in the event of a publication failure or technical issue affecting your content.
• Deleting your video files in accordance with the retention policy described in our Privacy Policy.
• Not using your content for any purpose other than the agreed publishing service.

5. Intellectual Property

You retain full ownership of all content you provide to Chearbear. By delivering content to us, you grant Chearbear a limited, non-exclusive, non-transferable license to store, process, and publish that content solely for the purpose of delivering the agreed service. This license terminates automatically upon deletion of the content from our systems.

Chearbear does not claim any ownership over your content and will not use it in any promotional, editorial, or commercial context without your explicit written consent.

6. TikTok Platform Compliance

Our service operates through TikTok's official Content Posting API and is subject to TikTok's platform policies. You acknowledge that:

• TikTok may modify or restrict API access at any time, which may affect our ability to deliver the service.
• Content that violates TikTok's guidelines may be removed or rejected by TikTok without prior notice.
• Chearbear is not responsible for decisions made by TikTok regarding content moderation or account restrictions.

7. Service Availability

We strive to maintain high availability of our platform. However, we do not guarantee uninterrupted service. Downtime may occur due to maintenance, third-party API limitations (including TikTok and Dropbox), or circumstances beyond our reasonable control. We will make reasonable efforts to notify you of planned maintenance in advance.

8. Limitation of Liability

To the maximum extent permitted by Argentine law, Chearbear shall not be liable for any indirect, incidental, special, or consequential damages arising from:

• Publication delays or failures caused by third-party platform outages (TikTok, Dropbox).
• Content removal or account actions taken by TikTok.
• Loss of revenue or business opportunity associated with delayed or failed publications.
• Unauthorized access to your accounts resulting from circumstances outside our control.

Our total liability for any claim arising from the use of our service shall not exceed the amount paid by you for the service in the month in which the incident occurred.

9. Termination

Either party may terminate the service agreement at any time with reasonable notice. Upon termination, we will: revoke and delete your OAuth tokens, delete any pending or unpublished video files from our systems within 7 days, and cease all access to your TikTok account.

We reserve the right to suspend or terminate access to our service immediately if we determine that you have violated these Terms or applicable law.

10. Modifications to These Terms

We may update these Terms from time to time. We will notify active clients of material changes via email. Continued use of the service after the effective date of any update constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Argentine Republic. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the City of Buenos Aires, Argentina.
