This Privacy Policy describes how Chearbear ("we", "us", or "our", Buenos Aires, Argentina, collects, uses, stores, and protects the personal data and content you provide when using our social media content publishing platform. Video files delivered to us are stored in our Dropbox account solely for the purpose of processing and publishing. Our system applies the following automated retention policy:
We do not retain video content beyond the periods described above. We do not share, sell, license, or otherwise distribute your media files to any third party other than TikTok as required to fulfill the publishing service.
TikTok access tokens and refresh tokens are stored securely and are used exclusively to operate the publishing service. Tokens are immediately revoked and deleted from our systems when you disconnect your TikTok account or terminate the service agreement. We do not retain tokens after account disconnection.

We apply reasonable technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction. OAuth tokens are stored using encryption. Video files in Dropbox are accessible only to authorized personnel of Chearbear.
Access to the Chearbear platform is protected by two-factor authentication (2FA) via Google Authenticator, requiring both a password and a time-based one-time code for every login. This ensures that your connected TikTok credentials and scheduled content are accessible only to explicitly authorized operators, even in the event of a compromised password.
Despite these measures, no system can guarantee absolute security, and we encourage you to contact us immediately if you suspect any unauthorized use of your account.
As a data subject under Argentine Personal Data Protection Law No. 25.326, you have the following rights:

The service includes content scheduling, OAuth-based account connection, and publication management via authorized third-party APIs.
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our service. By using Chearbear, you represent and warrant that you meet these requirements. The service is intended for professional and business use only.

You retain full ownership of all content you provide to Chearbear. By delivering content to us, you grant Chearbear a limited, non-exclusive, non-transferable license to store, process, and publish that content solely for the purpose of delivering the agreed service. This license terminates automatically upon deletion of the content from our systems.
Chearbear does not claim any ownership over your content and will not use it in any promotional, editorial, or commercial context without your explicit written consent.
Our service operates through TikTok's official Content Posting API and is subject to TikTok's platform policies. You acknowledge that:
We strive to maintain high availability of our platform. However, we do not guarantee uninterrupted service. Downtime may occur due to maintenance, third-party API limitations (including TikTok and Dropbox), or circumstances beyond our reasonable control. We will make reasonable efforts to notify you of planned maintenance in advance.
To the maximum extent permitted by Argentine law, Chearbear shall not be liable for any indirect, incidental, special, or consequential damages arising from:
Our total liability for any claim arising from the use of our service shall not exceed the amount paid by you for the service in the month in which the incident occurred.
Either party may terminate the service agreement at any time with reasonable notice. Upon termination, we will: revoke and delete your OAuth tokens, delete any pending or unpublished video files from our systems within 7 days, and cease all access to your TikTok account.
We reserve the right to suspend or terminate access to our service immediately if we determine that you have violated these Terms or applicable law.
We may update these Terms from time to time. We will notify active clients of material changes via email. Continued use of the service after the effective date of any update constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the Argentine Republic. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the City of Buenos Aires, Argentina.
